there was more damage to the front of my car than to the back of his (I hit the little thing that holds spare tires). I was inching up behind him and I went to put on the brakes and my foot slipped off them somehow and my car kept going. :( so now my dad is making me go to court, so that I can hopefully get this ticket dropped and off my record. problem was, it was my fault, so how am I supposed to plead not guilty?
has anyone been in court for shit like this? nobody expects the guy to come, because his insurance will be able to cover it, but if he does, what happens then? and even if he doesn't come, and I plead not guilty, will they ask me what happened?

my dad is PISSED. I'm required to pay everything from all this. and my car's hood is slightly raised in one spot. it's not required to fix it, but he's making me fix it anyway just so I can pay for that too. I also now have to get a job because I don't have enough money in my bank account.
also, I have to go to court alone.

usually you'd want to settle out of court, because insurance is probably bad when you make real claims. Unless it's a lot of money for repairs.

I don't know, I just hope the guy doesn't show up. he should have no reason to, since his insurance will fix everything. I'm guessing it's MAYBE about 400-500 dollars at the most for him.

yeah, and so the ticket gets dropped. but that will only happen if the other guy doesn't come. and I don't really know. I've never hit anyone before.
also: yes, I spoke with him. luckilly he was very nice and so were the cops. I was pretty upset.

If your ticket requires you to make a court appearence, then no, you cant settle it out of court. but dont worry, traffic court is nothing. when they say 'court' they really mean little room with a desk and two chairs and a judge. thats it, no pedestal or chair you have to testify on, no jury, no laywers, just you and the judge. It makes it a lot easier to explain your case and get done. Its over in about 5 minutes too.
BUT FIRST I NEED SOME MINOR DETAILS PLEASE:
was there a ticket involved given to you by a uniformed police officer, or is he (the citizen) taking you to court?
because if the cop doesnt show for a ticket he wrote, you win automatically.
if its a case betwenn you and the man, and he doesnt show, you win.
youll win if nobody shows, and honestly, chances are good that the cop wont show.

well, the thing is, I'm NOT required to make a court appearence. I could just fill out the report, plead guilty and send in 75 dollars and be done with it, but then it goes on my record.
if I go to court, plead not guilty and the guy doesn't show, then it gets dropped off my record and I lose the ticket. I have to ask our insurance guy what will happen then.
the ticket was given to me by a cop, and I'm going to court just because my dad called my uncle who is a cop. he told him that I should go to court, so now I have to.

anyway, if I plead not guilty to the judge, with the guy not there, do I have to explain myself or do they just go, "okay whatever, he's not here, bye."? that's what I'm worried about, because how do I prove that I "didn't do it"?

This was her first mistake (and It happens to everyone) she doesn't have all the legal advice in the world & she needs support. if i were you, i would just tell my father that i got a ticket for something i did and it's part of the consequence of having an accident. then it would be up to him to accept your decision and give you the time to make enough money to pay him back for the car repairs.

i just clipped the the rear passenger bit of her car, and crunched up the driver's side headlight and the front quarter panel of mine (Fox saw the damage) and they dropped me. not because i got a ticket though (which was only for "following too closely" and just like, $75).

damn, that sucks...there was no visible damage to the guy's car though. he even opened his trunk just to make sure it wasn't jammed, and it opened fine. he didn't even have a scratch. I hit his tire thing directly. now my car, the grill is cracked and I have a dent in the middle of the hood, which pushed parts of the hood upwards. it still opens and closes though, so that's good.
